So it\u2019s worth checking carefully:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Is the fixed-term rental agreement even valid?<\/strong><\/li>\n\n\n\n<li><strong>What happens if the fixed term is invalid?<\/strong><\/li>\n\n\n\n<li><strong>What are the consequences if it is valid?<\/strong><\/li>\n<\/ol>\n\n\n\n<p>In German tenancy law, there are two types of fixed-term rental agreements for residential property. Both are only valid under specific conditions. In particular, there must be a legally recognized reason.<\/p>\n\n\n\n<p class=\"has-text-align-center has-color-accent-mod-color has-text-color has-link-color has-large-font-size wp-elements-74faa2cd44fbef7f09ee4c2b62429687\"><strong>1. Short-Term Tenancy (\u00a7 549 Para. 2 No. 1 BGB)<\/strong><\/p>\n\n\n\n<p>Recently, so-called short-term rental agreements for temporary use are becoming more common. They are based on \u00a7 549 Para. 2 No. 1 BGB.<br>Here, the landlord claims you only want to use the apartment for a short time.<\/p>\n\n\n\n<p class=\"has-color-accent-mod-color has-text-color has-link-color wp-elements-1756ec2f83c9f611d8733906f4c7c55b\"><strong>Time factor \u2013 How long can the term be?<\/strong><\/p>\n\n\n\n<p>For the term to be valid, the use must truly be temporary<br>Courts have not yet fully agreed on when the period becomes too long:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Some courts find 12 months too long.<\/li>\n\n\n\n<li>Some consider more than 6 months to indicate regular use.<\/li>\n\n\n\n<li>Others draw the line at 3 months.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-color-accent-mod-color has-text-color has-link-color wp-elements-494b1fb18dc792484838cdbabd0f7dbb\"><strong>Special purpose \u2013 Is there a real reason for the short-term lease?<\/strong><\/p>\n\n\n\n<p>The rental must not only be short but must also have a concrete reason. Mere claims by the landlord (&#8220;You&#8217;re only staying briefly&#8221;) are not enough.<br>Most courts require a so-called special purpose.<\/p>\n\n\n\n<p><strong>Examples of valid reasons:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A clearly limited internship or semester.<\/li>\n\n\n\n<li>A temporary work assignment.<\/li>\n<\/ul>\n\n\n\n<p>In practice, landlords often just assert you want to stay briefly \u2013 without actual basis. Frequently, this is written into the contract without informing you beforehand.<\/p>\n\n\n\n<p>Important: The landlord has to explain and prove the reason. If this is not plausible, there&#8217;s strong indication that it&#8217;s actually an unlimited rental contract.<br>Be careful about what you say during viewings or in communications \u2013 it could be used later.<\/p>\n\n\n\n<p><strong>Consequences:<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><td><strong>Situation<\/strong><\/td><td><strong>Consequence<\/strong><\/td><\/tr><\/thead><tbody><tr><td><strong>Valid short-term lease<\/strong><\/td><td><strong>&#8211; Lease ends automatically on the agreed date<br>&#8211; Rent control (Mietpreisbremse) doesn&#8217;t apply (\u00a7 549 BGB)<br>&#8211; Landlord can demand immediate move-out<br>&#8211; Court may grant a short eviction period under \u00a7 721 ZPO, but no long protection period<\/strong><\/td><\/tr><tr><td><strong>Invalid short-term lease<\/strong><\/td><td><strong>&#8211; Lease becomes unlimited<br>&#8211; Termination only for legal reasons (e.g., personal use, breach of contract)<br>&#8211; Rent control applies<\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p><strong>Tip:<br>It&#8217;s often worth getting advice or even having the invalidity confirmed in court.<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center has-color-accent-mod-color has-text-color has-link-color has-large-font-size wp-elements-9b7d49e0c59746874e5fb25d6ade50a0\"><strong>2. Fixed-Term Tenancy (\u00a7 575 BGB) \u2013 Landlord&#8217;s Future Plans<\/strong><\/p>\n\n\n\n<p>These are genuine fixed-term contracts with an end date because the landlord has a valid reason. This is regulated under \u00a7 575 BGB.<\/p>\n\n\n\n<p><strong>Valid reasons (\u00a7 575 Para. 1 BGB):<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Personal use \u2013 The landlord or close family intends to move in after the term.<\/li>\n\n\n\n<li>Planned renovations or modernization that are incompatible with your continued occupancy.<\/li>\n\n\n\n<li>Connection to an employment relationship \u2013 very rare, get advice!<\/li>\n<\/ol>\n\n\n\n<p><strong>Formal requirements:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The reason must be in writing in the rental agreement and clearly described!<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>For personal use: Who exactly will move in? (e.g., daughter, mother, etc.)<\/strong><\/li>\n\n\n\n<li><strong>For modernization: What measures specifically? Why can&#8217;t they be done while you live there?<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>Simple phrases like &#8220;due to personal use&#8221; are not enough!<\/p>\n\n\n\n<p><strong>If the fixed term is formally valid \u2013 Four-month rule (\u00a7 575 Para. 2 &amp; 3 BGB):<\/strong><\/p>\n\n\n\n<p>You can, at the earliest, 4 months before the end date, ask the landlord to confirm:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Whether the reason for the fixed term still exists.<\/li>\n\n\n\n<li>When and how exactly it will be implemented.<\/li>\n<\/ul>\n\n\n\n<p>Landlord\u2019s duty to respond: 1 month.<br>If they fail to reply or the reply is insufficient \u2192 The tenancy continues until a proper response is given.<br>If false information is provided or the reason no longer exists \u2192 The tenancy becomes unlimited.<\/p>\n\n\n\n<p><strong>Consequences:<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><td><strong>Situation<\/strong><\/td><td><strong>Consequence<\/strong><\/td><\/tr><\/thead><tbody><tr><td><strong>Invalid fixed term<\/strong><\/td><td><strong>Rental agreement becomes unlimited<\/strong><\/td><\/tr><tr><td><strong>Formally valid fixed term<\/strong><\/td><td><strong>&#8211; Lease ends automatically<br>&#8211; No protection against termination<br>&#8211; Eviction lawsuit possible<br>&#8211; Court cannot grant an eviction period (\u00a7 721 Para. 7 ZPO)<br>&#8211; Rent control applies during the contract term but must be claimed within the term (and no later than 30 months after contract start)<\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p><strong>Important:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>No hardship clause (\u00a7 574 BGB) \u2013 You cannot claim special hardship to stay longer.<\/li>\n\n\n\n<li>After the term expires, you are obligated to move out. Otherwise, you risk costs (eviction lawsuit, damages, etc.).<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-center has-kb-palette-2-color has-text-color has-link-color has-large-font-size wp-elements-6a5cc061112e94720feb5aa02ad06971\"><strong>Conclusion:<\/strong><\/p>\n\n\n\n<p><strong>Fixed-term rental contracts are often flawed. <\/strong><strong>It\u2019s always worth checking:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Is there a valid reason for the fixed term?<\/strong><\/li>\n\n\n\n<li><strong>Is the reason properly described?<\/strong><\/li>\n\n\n\n<li><strong>Does the contract reflect your actual intention to stay?<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>Get advice:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Free legal advice services in your district<\/strong><\/li>\n\n\n\n<li><strong>Major tenant organizations (e.g., Berliner Mieterverein, Mietergemeinschaft)<\/strong><\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-text-align-center has-color-accent-mod-color has-text-color has-link-color has-extra-large-font-size wp-elements-00470cbca79b19de26b8089525cc310f\"><strong>Options for Action<\/strong><\/p>\n\n\n\n<p><strong>Steps to take in order to effectively challenge rent levels and fixed-term leases:<\/strong><\/p>\n\n\n\n<p>If you need advice on getting your lease extended, see above!<\/p>\n\n\n\n<p>Check for rent gouging, reduce your rent, and take action.
